This was an application to the district court by the plaintiff in error for license to sell real estate-belonging to the estate of Warren B. Dunlap, of which estate he alleges he is the administrator. The license was granted, the land sold to the defendant in error, and th$ report thereof made to the district.court in due form. Upon motion for confirmation the defendant in error in writing called the attention of the court to the fact, which was disclosed by the records, that at the time of the death of the intestate he was a resident of Lancaster county, Nebraska, and that the letters of…
