DENISON, Circuit Judge.
This case is in effect a suit for infringement and unfair competition brought by the I. T. S. Company against the Tee Pee Company; the infringement charged being based upon the Tufford reissued patent No. 14,049 for rubber lifts for shoe heels. The District Court granted a preliminary injunction, but on appeal this order was reversed. Tee Pee Co. v. I. T. S. Co. (C. C. A.) 268 Fed. 250.
