At issue is the legality of the placement of New York City *206foster-care children in out-of-State residential facilities. Seeking class action certification to represent the more than 300 others who, they claim, are similarly situated, plaintiffs, three children placed with the New York City Department of Social Services, sue the Commissioners of the City and State Departments of Social Services in both their individual and representative capacities for declaratory and injunctive relief, as well as damages.
