An instrument purporting to be the will of Peter Magnes, deceased, was presented to this court for probate and record on the 23d of April, 1902. Caveats or objections to the probate of said will have been filed in this court by the widow and children of the deceased. The objections are very numerous, but for the purpose of this decision it is not necessary that they all be considered. It is sufficient to say that they not only question the testamentary capacity of the deceased and thus raise the issue devisavit vel non, but they also contain numerous objections which go to the legality and…
