Appeal by the defendant from a judgment of the Supreme Court, Suffolk County (D’Amaro, J.), rendered March 5, 1985, convicting him of grand larceny in the third degree and criminal possession of stolen property in the third degree, upon a jury verdict, and imposing sentence.
Ordered that the judgment is affirmed.
The defendant’s contention that he was deprived of his right to a trial by jury, when the court instructed the jury that the issue of whether or not the witnesses were sworn was not a proper one for its consideration, is without merit. The trial court repeatedly instructed the jurors…
