Presently before the Court are cross-motions for summary judgment filed by the parties. The Secretary of Labor (the “Secretary”) asserts in his motion that Richard Kwasny violated Title I of the Employee Retirement and Income Security Act of 1974, as amended 29 U.S.C. § 1001, et seq. (“ERISA”) by failing to deposit' employee contributions into the Kwasny and Reilly, P.C., 401(k) Profit Sharing Plan (the “Plan”).
