MEMORANDUM OPINION AND ORDER

DECKER, District Judge.

Plaintiff, Norma Thiel (Thiel), brought this action against the defendant, Prudential Insurance Company of America (Prudential). Their dispute arises out of Prudential’s refusal to pay Thiel’s medical expenses incurred in July of 1981. Plaintiff alleges Prudential was obligated to pay her medical costs under the parties’ insurance agreement. Count I of the complaint seeks recovery of those expenses, a statutory penalty, and attorney’s fees under IlLRev. Stat., ch. 73, § 767.
