The action is for personal injuries suffered by the plaintiff' as the result of a motor vehicle accident while she was riding as a guest in an automobile owned by the defendant Joseph La Delpha and operated by defendant Frances *180La Delpha in the State of New York. All of the parties are residents of the province of Ontario, Canada. The summons and complaint were served upon the defendants pursuant to section 52 of the Vehicle and Traffic Law, which provides for a substituted service upon nonresident defendants in cases arising out of a motor vehicle accident within this State.
