This case comes on to be heard on a motion by counsel for the appellee to strike the stenographer’s transcript from the record and to dismiss the appeal for the reason that the transcript was not filed within the time allowed by law; it having in fact been filed more than one year *228after the rendition of the judgment appealed from. The appeal bond was not filed until after the expiration of the time allowed by law for appeals to this court, but the rights of-the appellee growing out of that fact are not involved on this motion; there being an agreement in the record by counsel covering that…
