OPINION DISSENTING FROM DENIAL OF EN BANC REVIEW

EVELYN V. KEYES, Justice.

I respectfully dissent. As the panel opinion states, this wrongful death and survival case arises from the drowning deaths of nine-year-old twin girls, AS and SS, and their father, Hector Suarez,, in Galveston Bay at a recreational area owned and operated by the City of Texas City. Edith Suarez, the twins’ mother and Hector’s wife, filed suit against the City asserting wrongful death and survival claims.
