— In a probate proceeding in which David M. Geshwind petitioned pursuant to SCPA 1809 to determine the validity of a claim against the estate of the decedent Max Geshwind, the petitioner appeals from an order of the Surrogate’s Court, Nassau County (Riordan, S.), dated October 29, 2007, which, upon a decision of the same court dated September 26, 2007, granted the motion of Frank B. Geshwind, as executor of the decedent’s estate, for summary judgment denying the petitioner’s claims and denied the petitioner’s cross motion for partial summary judgment.
