Purnell, United States marshal for western district of Texas, Clifton Witherspoon, his deputy, Gregg & Ford, Briggs, Payne & Co., and W. D. Simmons, for damages for maliciously and wrongfully breaking open the storehouse of plaintiff, and taking therefrom goods of the value of $4,896.80; both actual and punitory damages were claimed.
