Appeal from a judgment of the Supreme Court (Devine, J.), entered January 23, 2014 in Albany County, which, in a proceeding pursuant to CPLR article 78, granted respondents’ motion to dismiss the petition.
Petitioner owned and operated a nursing home facility in the City of Middletown, Orange County until March 2010, when the facility was sold to its current operator. The facility provided services to patients who were eligible for both Medicaid and Medicare Part B benefits.
