The defendants subscribed for capital stock in. a proposed corporation, their subscriptions being identical except as to amount. The defendant Gunn’s subscription was in the following language: “ Subscription to the capital' stock of a corporation to be organized for the purpose of erecting a hotel on the Dempsey property. — Macon, Ga., March 8th, 1911.
