Action to recover damages for the construction and maintenance of a railroad bridge across a public street, the fee of which was alleged to he in the plaintiff, and for consequential damages to lands claimed to he part of the lands taken for said bridge.

The plaintiff owns a rectangular block of land in the city of Buffalo, bounded on the north by Otto street, on the east by Alabama street, on the south by Perry street, and on the west by Haywax’d street. In 1882 the Lehigh Valley Railway Company purchased, for the purpose of the construction of part of its main line, the land on both sides of Alabama street north of Otto street. Across this property in 1884 the Lehigh Valley built its main line into the city of Buffalo, crossing Alabama street approximately at right angles on an overhead structure, pursuant to the provisions of the Railroad…
