The plaintiff in error, referred to hereinafter as the defendant, was indicted in three counts, charged with vio-' lations of section 3, tit. 1, of the Espionage Act of June 15, 1917, c. 30, 40 Stat. 217 (Comp. St. 1918, Comp. St. Ann. Supp. 1919, § 10212c). He was found guilty on all counts and sentenced on the first count to pay a fine of $5,000 and the costs of the prosecution and to imprisonment for a period of three years; on the second and third counts he was sentenced on each count to imprisonment for three years, the imprisonment to be concurrent in all three…
