MEMORANDUM OPINION AND ORDER

GEORGE HOWARD, Jr., District Judge.

Plaintiff brings this action for mandamus and injunctive relief, pursuant to 28 U.S.C. §§ 1331 and 1361, requesting that the Court require the Department of the Navy to upgrade plaintiffs 1969 undesirable discharge from the United States Marine Corps. Plaintiff also seeks a declaratory judgment that his constitutional right to due process was violated.
