PEE CURIAM.
From a judgment of conviction upon a charge of stealing twelve hundred sacks of cement, of the value of twelve hundred dollars, the property of the state of Arizona, the defendant appeals.
The facts are that in 1919 the state was engaged in road construction, and in such work it was using quite a large amount of cement. The road work was under the supervision of the state engineer, with subordinates who had immediate charge and. control of the state’s property used in' such work.
