This was an action of debt brought in the Circuit Court for the district of Virginia by Petit and Bayard against Seth Barton and Tl.tomas Fisher, upon a judgment rendered in the General Court of Maryland. Tlie declaration is against the said Barton and Fisher, late merchants and partners, trading under the firm of Barton and Fisher, citizens and inhabitants of the state of Virginia, both of whom are alleged to be in the custody of the marshal.
