Appeal from an order of the Family Court of Madison County (DiStefano, J.), entered January 22, 2004, which dismissed petitioner’s application, in a proceeding pursuant to Family Ct Act article 6, to modify a prior order of custody.

At the time of the commencement of this proceeding, the parties’ son was 16 years old. The child had resided with petitioner and her mother in Oneida County until he was placed with the Department of Social Services into the Kids Peace Program as a result of a juvenile delinquency charge.
