dissenting: I think the act unconstitutional as impinging four articles of the Constitution óf North Carolina, and void for uncertainty, and injunctive relief should have been granted.

*679Article I, sec. 7, is as follows: “No man or set of men are entitled to exclusive or separate emoluments or privileges from the community but in consideration of public services.”

Article I, sec. 31: “Perpetuities and monopolies are contrary to the genius of a free state and ought not to be allowed.”
