In the county court of Milwaukee county a' claim was filed for $2,500 against the estate of a deceased person. The case came on appeal -to the circuit court, was tried before a jury, and the court submitted one question which was as follows: “Did the claimant, Ray Reiss, on February 10 or February 11, 1914, loan to Mary Washburn Utter the sum of $2,500?” The answer was “No.” Among other instructions the following were given;

“14. If you are satisfied by evidence that is clear, convincing, and satisfactory that the claimant, Ray Reiss, on February 10 or February 11, 1914, loaned to Mary…
