*474This is an appeal from a judgment entered in the district court of the sixteenth judicial district, Custer County, Hon. A. B. Martin, sitting without a jury. Defendant was found guilty of possession of gambling implements and sentenced to imprisonment in the Custer County jail for a term of three months with the provision that upon payment of a fine in the amount of $750, the term of imprisonment would be suspended.
