Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at *676Special Term, entered in Albany County) to review a determination of respondent denying petitioner’s application to, inter alia, annul the option one-half retirement option established for the decedent. Decedent, petitioner’s estranged husband, was employed as a security officer by the State of New York for about 22 years and was granted ordinary disability retirement effective July 21, 1977.
