The above-named defendant was found guilty by a jury verdict of rape in the first degree (Penal Law § 130.35 [1]), criminal trespass in the second degree (Penal Law § 140.15), assault in the second degree (Penal Law § 120.05 [6]) and resisting arrest (Penal Law § 205.30) in County Court, Monroe County, and was sentenced on September 25, 1985, on the top rape count to an indeterminate term having a minimum of 7 years and a maximum of 21 years.
