YANKWICH, District Judge.
I. The Issues on Review
On May 17, 1944, the C & P Company, a Nevada corporation, to which we shall refer as “the debtor-bankrupt”, filed a petition for arrangement under Chapter 11 of the Bankruptcy Act of 1938.
Upon the filing of the petition, the matter was referred to one of the Referees of this Court, since retired, the Honorable Ernest R. Utley. The debtor-bankrupt was allowed to remain in possession.
The chief asset of the debtor-bankrupt was a ranch of some 9,000 acres in Humboldt County, State of Nevada. On May 17, 1944, it filed a petition for an order to show…
