The question involved in this proceeding is the validity of the act creating the thirty-eighth judicial district. It purports to take Crawford *131county from the sixth judicial district and to make that county the new district. (Laws 1905, ch. 199.) After the passage and publication of the bill the governor appointed the Honorable Arthur Fuller to be judge of the new district, and he has since acted in that capacity, disposing of a large volume of business and rendering judgments in a great many cases, both civil and criminal.
