This is a motion to amerce the late sheriff of Cape May for failing to execute a writ of fieri facias. The only question necessary to be considered is whether the sheriff was guilty of any default.

The writ was transmitted to him by the plaintiff’s attorney on April 27th, 1878, accompanied by a letter of that date as-follows: “Under the enclosed writ you will please levy upon all the property you can find belonging to Jesse Deats, or in his possession and under his control, including his stock in trade, which is under cover of his…
