Action of ejectment tried by the court without a jury. The findings were in favor of defendant and plaintiff has appealed from the judgment entered after the denial of his motion for a new trial.
These are the facts: In 1913 John Heiberg acquired title toi a quarter section of land in Koochiching county. In 1914 he mortgaged it for $1,000. The mortgage was foreclosed by advertisement, and on March 20, 1920, the land was sold in two separate parcels.
