Appellee, R. E, Hutchins, filed suit against appellant, The City of Dallas, a municipal corporation, to recover damages for personal injuries sustained by his wife, Mae Hutchins, as a result of her stepping in a hole at nighttime on November 23, 1946. The point where the accident occurred was adjacent to Jefferson Boulevard, a public street in the City of Dallas. The City of Dallas interpleaded Austin Road Company, a private corporation, seeking to recover from it any damages that may be *157adjudged against the City.
