In an action against a New Jersey resident to recover damages for personal injuries sustained in an automobile accident which occurred in this State, the defendant, appearing specially, appeals from an order of the Supreme Court, Queens County, dated May 20, 1960, denying his motion to vacate the service of the summons and complaint upon him. Plaintiffs served the summons and complaint on defendant pursuant to statute (Vehicle and Traffic Law, § 253, formerly § 52).
