Jack Freeman, who stands convicted after trial in New York of second-degree assault, second-degree vehicular assault, common law driving while intoxicated (“DWI”), and leaving the scene of an accident, see People v. Freeman, 46 A.D.3d 1375, 1377, 848 N.Y.S.2d 800, 802 (4th Dep’t 2007), appeals from the judgment entered on November 19, 2010, in the Western District of New York (Michael A.
