ROSS, Circuit Judge.

The plaintiff in error was plaintiff in the court below. The action was commenced by him in that court, upon the ground of diverge citizenship of the parties, to recover $6,525, — the alleged value of his services as physician and surgeon, rendered to the deceased, Henry C. Nelson, during his lifetime. The original complaint alleged that by the last will of the deceased, which was duly admitted to probate on November 29, 1897, by the superior court of Colusa county, Cal., the plaintiff and the defendants J. Thad Jones, J. W. Goad, and R. E. Smith were appointed executors…
