The bill of complaint filed in this cause seeks the enforcement of a mechanics’ lien for bricks used in the erection of certain houses in the City of Baltimore. The testimony shows that sometime in the month of October, 1883, Charles W. Rockafeller visited the office of the appellant and stated that he and William J. Spilman were negotiating for the purchase from George R. Clark of certain lots of ground in Baltimore for the purpose of building thereon forty-seven houses.
