OPINION

SWEET, District Judge.

Defendant, Local 32B-32J, Service Employees International Union, AFL-CIO (the “Union”), has moved for summary judgment seeking dismissal of the complaint under Rule 56, Fed.R.Civ.P., of plaintiff Danny Hill (“Hill”) appearing pro se. *929Upon the following findings and conclusions, the motion is granted.
