A jury found Appellant, Abraham Cava-zos, guilty of murder and imposed a punishment of twenty-eight years’ confinement and a $5,000 fine. Cavazos v. State, 329 S.W.3d 838 (Tex.App.-El Paso 2010). Appellant appealed, claiming that the trial court erred by refusing his requested jury instruction on the charge of manslaughter. Id. at 840.
