CUSHMAN, District Judge.

The libel is in rem by the assignee of the bill of lading to recover for the loss of 1,769 cases of eggs, containing 30 dozen each, and for damage to eggs in the remaining cases, in a shipment totaling 3,400. The eggs were shipped from Shanghai, Oc-*697tobcr 24, 1914, to Seattle, which port they reached November 21st of the same year. The. causes of the loss and damage, as set forth in the libel, are:
