In Coffey v. Gay, 191 Ala. 137, 67 So. 681, L. R. A. 1915D, 802, the bank had been placed in the hands of a receiver by order of the chancery court; held that, though the receiver was authorized to institute action, the same court having decided against the claim, said receiver cannot appeal without consent.
