The indictment alleges (1) that the defendants were respectively president and secretary of the Delaware Surety Company, a corporation duly organized under the laws of the State of Delaware; (2) that the laws of that State required such officers to make a sworn certificate of the amount of the capital stock of the corporation which had been paid in in cash, and file it with the Secretary of State; (3) that on the 15th day of May, 1901, in the county and State of New Tork, the defendants appeared before a notary public of that State and county and severally swore to a certificate that…
