The plaintiff in this case was defendant in a suit brought against him for divorce in the Superior Court of the city of Detroit by his wife, Susanna Eoss, on the 4th day of September, 1880. He was personally served with process in that suit,, and appeared and answered the bill of complaint, which averred his ability to pay alimony, and that fact was not denied in his answer, which was filed on the thirteenth day of September, 1880. On the day the answer was filed tlie circuit court made an order requiring Eoss to pay to his wife $50, for solicitor’s fees, within twenty days, $20 per week…
