On September 28, 1981, the plaintiff-carriers (hereinafter collectively “Maersk”) commenced this adversary proceeding against Black & Geddes, Inc. (“B & G”), the debtor, and Chester B. Salomon, as Trustee of B & G (the “Trustee”), seeking to impose a constructive trust in the amount of $38,-265.21 on funds in the hands of the Trustee. 1 On October 28, 1981 prior to answering, the Trustee moved to dismiss the complaint on the grounds that it failed to state a claim upon which relief could be granted.
