Defendant was charged by information in two counts with the crime of rape and in two additional counts with the crime of incest. Counts I and II are predicated upon the same act of sexual intercourse, while counts III and IV are based upon a similar act upon another date. Following the entry of pleas of not guilty to all counts, the cause was tried before the court sitting without a jury, resulting in the conviction of defendant on all four counts.
