The plaintiff in error was indicted in the superior court of the county of Early, for the murder of Flora Elizabeth Lubjq his wife. He was tried, and the jury rendered a verdict of guilty. He made a motion for a new trial, which was overruled by the presiding judge. He excepted, and we are to determine whether the judge below committed error in overruling the motion. There are eight grounds set out in it. The first two are, that the verdict is contrary to the evidence, and without evidence to support it; and that the verdict is contrary to law.
