OPINION
WILLIAMS, Circuit Judge:
The Monongahela Power Company seeks review, both on appeal and by petition for writ of mandamus, of the district court’s determination that neither § 514(a) of the Employee Retirement Income Security Act (ERISA), 29 U.S.C. § 1144(a) (1988), nor § 301 of the Labor Management Relations Act (LMRA), 29 U.S.C. § 185 (1988), preempts the claim of the plaintiff, Bruce Nutter. Because preemption under ERISA and the LMRA was the basis for removal to federal court, the district court concluded that it lacked jurisdiction and remanded the case as required under 28 U.S.C.A.…
