Appeal from a judgment of the Supreme Court (Hughes, J.), entered August 8, 1997 in Albany County, which, inter alia, granted petitioner Gregory Burch’s application, in a proceeding pursuant to Election Law § 16-102, to declare valid the designating petition naming Burch as the Democratic Party candidate for the office of President of the Common Council of the City of Albany in the September 9, 1997 primary election.
