Petitioner in this class action instituted an article 78 proceeding to review a determination of respondents-appellants, herein Commission, which declared petitioner and all other policewomen ineligible to participate in an examination for promotion to police sergeant. Special Term granted the application to the extent of directing a trial of the issue, and left to determination by the trial court whether or not it reasonably may be concluded that policewomen could reasonably perform such assignments in the Police Department, currently performed by male sergeants, so as to warrant promotion…
