This litigation grows out of a collision between a panel truck owned and driven by the plaintiff and a truck owned by the defendants Anderson operating under the trade name of The Hartley Creamery and driven by the defendant Boernsen. The collision occurred at the intersection of First Street N.E. and Third Avenue E. in the Town of Hartley, about six o’clock, or a few minutes earlier, on December 7, 1954. It was stipulated that sunset in this area came at 4:46 p.m. on the date in question. First Street N.E. is 66 feet wide and runs east and west; Third Avenue is 80 feet in width and extends…
