I am constrained to dissent from the judgment of the court. In my opinion it is sustained neither by principle nor authority. The note in suit is for $3,100, dated April 1, 1899, and payable four months after date. It was given in part payment of the price of certain machinery for an elevator bucket dredge furnished by the Vulcan Iron Works Company to the Boise Dredging Company. The affidavit of defense sets out as an exhibit thereto attached a certain written contract between the two companies above mentioned dated May 11, 1898, whereby the Vulcan Company agreed for the consideration therein…
