This is a suit by the Furniture Hospital, a corporation, to enjoin defendant from tbe use of tbe name “New Tork Furniture Hospital” in connection with bis business of furniture repairing at No. 1704 Troost Avenue, Kansas City, Missouri, on tbe ground that tbe name “New Tork Furniture Hospital” by tbe respondent was an unlawful use of plaintiff’s trade name “Tbe Furniture Hospital,” and constituted unfair competition as against tbe appellant herein.
