Plaintiff alleges that defendant agreed to sell, and that he agreed to buy from her, certain property belonging to her in the city of Shreveport, on March 21, 1916; that defendant authorized R. R. Emery to consummate the sale for $40,000, and that said Emery did so on the day and *729date mentioned and for the amount agreed upon, and that he (plaintiff) had paid $1,000 cash on the purchase price; that he notified defendant on March 30, 1916, that he was ready to accept title and to pay the balance of the purchase price, but that defendant refused ■ to make title to him.
